TPLUS Digital Company limited TERMS AND CONDITIONS

By activating or using our Services you agree to be bound by this Agreement

  1. Effective Date: This Agreement comes into force and effect from the date you sign it

  2. Governing Laws: This Agreement shall be governed by the laws of Lao PDR. In case of any dispute between the Parties, the Parties shall first try to resolve amicably, if the Parties fail to reach a mutual conclusion, the Dispute shall be referred to Arbitration at the Economic Dispute Resolution Centre, Vientiane Lao PDR.

  3. Changes to the Charges: We may change or increase the charges for the Services; however, we shall inform you of any such change. We have the right to change any plans offered and the schemes offered with the plans.

  4. Handset Policy: The Handset is your property and we shall not be responsible in any nature whatsoever including but not limited to theft, loss, repair, maintenance or for fixing of any service, mechanical or technical problem of the handset. We shall have the right to refuse to provide the service or terminate the subscription for not using appropriate handset.

  5. Service Availability and Limits: Service to you is only available when the handset/unit is within the range of the network coverage. Even within the coverage area, factors such as network changes, traffic volume, transmission limits, service outages, technical limitations, signal strength, customer’s equipment, interconnecting carriers, weather etc may interfere with the actual service quality and availability. Some services are not available on third Party network or in roaming market. We may impose credit, usage or other limits to Service or other Services, cancel or suspend Service or block certain types of calls or sessions (such as international calls) at our own discretion. We may suspend Service without notice if you exceed any credit limit.

  6. Use of Service: By signing this Agreement you agree to use the Services for minimum one year. You may not sell or attempt to sell any aspect of the Service or other Services, whether for profit or otherwise. You have no proprietary or ownership right to a specific number (Number) assigned to you or on your Unit. We may change your number anytime at our own discretion. You may not use the number or the Services for any fraudulent, unlawful, abusive purposes or to cause any damage to business, reputation of any person. If we suspect any such acts, we have the right to (i) take immediate legal action, (ii) suspend the number without any notice (iii) suspends any or all Services immediately.

  7. Default and Termination: You will be at default under this Agreement, if you (i) do not pay any sum when due (ii) breach the Agreement or any other Agreement between you and us (iii) become the subject of any bankrupts or winding up (iv) become insolvent in all such cases you shall immediately make all payments and charges. If you are at default, we have the right to immediately cancel or suspend all Services. In case of early termination by you, we have the right to claim the remainder of the term of one year.

  8. Billing and Charges: You agree to pay in full each month all charges for Services or other Services under the Agreement. If we do not receive full payment until due date, you shall be liable to late payment charges. You will be charged for Services and other features on a monthly billing cycle basis. We may change your billing cycle at any time. By using our Services you agree time is of essence for payment therefore you must pay in full by due date. If you believe that your bill contains incorrect charges, you have sixty(60) days from the date of first bill that contains charge to notify us or you waive your right to that charge. Please contact customer care so that we can review your account. If you accept a credit to resolve the issue, you agree that the issue is fully resolved. We may require you to describe the issue in writing and submit it to the nearest VIPLAO Centre.

  9. Taxes and Fees We invoice you for taxes, fees and other charges imposed on you or on us as a result of providing the Services. We will determine in our reasonable discretion the taxes and fees you are responsible to pay and the amount of those taxes which may increase or change at any time without notice. You shall also be liable to pay any other taxes or fees as imposed by the Government of Lao PDR.

  10. Disclaimer of Warranties: Except for any written limited warranties that may be provided, all Services, units and other Services are provided on an “as is” basis. You assume all responsibility and risk for using the Services. We do not authorize anyone to make a warranty of any kind on our behalf and you should not rely on any such statements.

  11. Indemnification: You agree to defend, indemnify and hold us any roaming or network partner and any TPLUS Digital Company limited affiliate harmless from and against any and all claims, demands, actions, liabilities, costs or damages arising out of your use of the Service, unit or other Services or your breach of the Agreement.

  12. Lost or stolen unit: If your unit/Handset is lost or stolen, you agree to notify us immediately, ask us to deactivate the lost unit/Handset. You will however be liable for any unauthorized airtime charge incurred on the lost unit/Handset until you notify us. You must fulfill the remainder of your fixed term by purchasing and activating a replacement unit or you would be considered to be in breach of terms of this Agreement and be liable to pay charges for the remainder of the term.

  13. Assignment: We may assign all or part of our right or duties under the Agreement without such assignment being considered a change to the Agreement and without notice to you. We are then released from all liability. You may not assign the Agreement without our prior written consent.

  14. Notice: We may send you a written notice on the address mentioned in the enrollment form. In case of change of address, you agree to inform us within 10days or such change.

  15. Severability: All terms and conditions herein contained are independent of each other. If any provision of these terms and conditions is held to be inapplicable or unenforceable , the balance of the terms and conditions remain unaffected and in full force and effect.

  16. Suspension of Services for non usage: If your Service (either prepaid or post paid) is not used for any activity (voice call, SMS, GPRS) for more than 180 days, we have the right to suspend it without any prior notice and as such you may restore the Services by notifying us within 30 days of such suspension.

  17. Signing Authority: You represent that you may legally enter into the Agreement, have received the copy of the Agreement and have read and clearly understood the terms and conditions. If activating on behalf of a corporate or other entity, you represent that you have full authority to bind that entity and if not, agree to accept personal liability for the account. You are responsible for all charges incurred by any person you authorize to access your account, or allow to use your unit, the Service or other Services.

  18. Service Provider’s Responsibility: TPLUS Digital Company limited responsibilities are explicitly stated in this Agreement and TPLUS Digital Company limited takes no other responsibility besides those stated expressly hereinabove.
